These Terms of Service (“Terms”) govern your access to and use of Nuage. By accessing or using Nuage, you agree to these Terms.

Eligibility and Account

You must be at least 16 years old to use Nuage.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information and keep your account information up to date.

Service Description

Nuage provides wellness-focused tools and experiences designed to support nervous system regulation, emotional wellbeing, reflection, self-awareness, and adaptive planning.

Features may include:

• guided wellness practices,
• journaling tools,
• voice reflections,
• wellness insights,
• emotional reflection tools,
• scheduling and balance support,
• and integrations with third-party services such as wearable wellness platforms and calendars.

Features may be modified, updated, suspended, or discontinued at any time.

Plans, Trial, and Billing

Nuage may offer a free plan, paid plans, and a time-limited trial on selected plans.

• Trial access duration and scope are shown in-app at the time of signup or activation.
• Paid plans are billed through our checkout provider and may auto-renew unless cancelled before renewal.
• You can review plan details, feature limits, and current plan status in your profile and plan pages.
• If you cancel a trial or paid plan, access typically continues until the current period ends, then plan limits may apply.

Wellness and Informational Support

Nuage may provide wellness insights, planning suggestions, recovery recommendations, reminders, reflections, summaries, or supportive prompts based on information you provide or connect through third-party services.

Certain features may use automated systems or AI-assisted technologies to generate insights, summaries, recommendations, or reflections.

These outputs are intended for informational and self-support purposes only and may not always be accurate, complete, reliable, or suitable for your personal circumstances.

You are responsible for evaluating whether any recommendation, insight, or suggestion is appropriate for you.

Nuage Coach Boundaries

Nuage Coach is an AI-assisted feature guide for using Nuage.

• It is not a therapist, healthcare provider, or crisis response service.
• It responds to chat content you choose to share and selected onboarding context.
• It does not automatically read your private journal entries or voice recordings.

No Medical Advice or Emergency Services

Nuage is not a medical device, healthcare provider, therapy provider, diagnostic service, crisis response service, or emergency service.

Content, insights, reflections, recommendations, and features provided through Nuage do not constitute medical advice, diagnosis, treatment, mental health care, or professional counseling.

Always seek qualified professional support regarding medical or mental health concerns.

If you are experiencing a crisis or emergency, contact your local emergency services or a qualified crisis support provider immediately.

Nuage does not monitor user activity or reflections in real time and cannot guarantee immediate support or intervention.

Third-Party Integrations

Nuage may allow you to connect third-party services, including wearable wellness platforms, calendars, and other integrations.

By connecting a third-party service, you authorize Nuage to access and process the information necessary to provide the connected feature.

Your use of third-party services is governed by their own terms, privacy policies, and practices. Nuage is not responsible for the availability, accuracy, functionality, or security of third-party services.

You may disconnect third-party integrations at any time through supported settings or provider controls.

User Content

You retain ownership of content you submit to Nuage, including journal entries, voice reflections, schedules, notes, recordings, and uploaded content.

By using Nuage, you grant Nuage a limited, non-exclusive license to host, process, store, encrypt, transmit, and display your content solely for the purpose of operating, maintaining, securing, and improving the service.

We do not claim ownership over your personal content.

Privacy and Security

Your use of Nuage is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your information.

Nuage implements reasonable technical and organizational safeguards designed to help protect user information, including encrypted storage for certain sensitive content.

However, no method of electronic storage, transmission, or security is completely secure, and we cannot guarantee absolute security.

Acceptable Use

You agree not to:

• misuse or interfere with the operation of Nuage;
• attempt unauthorized access to systems, accounts, or infrastructure;
• use Nuage for unlawful, harmful, fraudulent, abusive, or exploitative activities;
• attempt to reverse engineer, disrupt, or exploit the platform;
• upload malicious code or harmful content;
• use Nuage in a manner that could harm other users or the integrity of the service.

Intellectual Property

Nuage branding, software, designs, visuals, content, and platform materials are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, copy, or commercially exploit protected materials without prior written permission.

Termination

We may suspend, restrict, or terminate access to Nuage if:

• you violate these Terms,
• create risk or harm to the platform or other users,
• misuse the service,
• or if required for legal, security, or operational reasons.

You may stop using Nuage at any time.

Limitation of Liability

To the maximum extent permitted by law, Nuage is provided on an “as is” and “as available” basis without warranties of any kind.

We do not guarantee that the service will always be uninterrupted, secure, accurate, or error-free.

To the maximum extent permitted by law, Nuage and its operators are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from:

• your use of the service,
• reliance on recommendations or insights,
• interruptions or outages,
• unauthorized access,
• third-party integrations,
• or loss of data or content.

Updates to Terms

We may update these Terms from time to time.

If material changes are made, we may provide notice through the platform or other appropriate methods.

Continued use of Nuage after updated Terms become effective constitutes acceptance of the revised Terms.
